Welcome to Karmoto. By accessing or using our platform and services, you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using our services. If you do not agree to these Terms, you may not access or use the platform.
Service Description
Karmoto provides a comprehensive business operations platform including:
- Karmoto Connect: Automated customer communication services including SMS messaging for missed calls, two-way messaging, and business phone number management via Twilio
- Karmoto Onboard: Employee onboarding automation including document collection, e-signatures, and account provisioning across Google Workspace, Slack, GitHub, and other services
- Additional business management tools and integrations
Account Registration
To use Karmoto, you must:
- Be at least 18 years old
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activity under your account
Free Trial and Billing
New users receive a free trial period of one (1) month. During your trial, you have full access to the features of your selected plan. After the trial period:
- You must subscribe to a paid plan to continue using the service
- Current pricing is available on our pricing page
- You will be billed monthly via Stripe
- You may cancel at any time before the trial ends to avoid charges
- All fees are non-refundable except as required by law
- We reserve the right to change pricing with 30 days' notice
SMS Communications and Consent
By placing a call to a business that uses Karmoto Connect, you consent to receive an SMS message response if your call is not answered. Key points regarding SMS communications:
Implicit Consent
By initiating a phone call to a business, you provide implicit consent to receive communications related to that call via SMS.
Message Purpose
SMS messages sent through our service are transactional responses to missed calls, informing you that your call was not answered and providing next steps for contacting the business.
Opt-Out
You may opt out of future messages by replying STOP to any message. Standard message and data rates may apply based on your mobile carrier's plan.
No Marketing
Businesses using Karmoto may only use the service for transactional missed call notifications and legitimate business communications, not for unsolicited marketing or promotional messages.
Acceptable Use
You agree not to use Karmoto to:
- Send spam, unsolicited messages, or marketing without consent
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit harmful, threatening, or harassing content
- Interfere with the service or other users
- Violate Twilio's Acceptable Use Policy
- Send messages to numbers on the National Do Not Call Registry (except as permitted)
- Use our services to facilitate discrimination or harassment
Service Availability
While we strive to provide reliable service, Karmoto is provided "as is" without warranties. We do not guarantee uninterrupted service and are not liable for:
- Service interruptions or downtime
- Failed message delivery
- Issues with third-party services (Twilio, carriers, integration providers)
- Loss of business or revenue
- Data loss or corruption
Data and Privacy
Your use of Karmoto is also governed by our Privacy Policy. By using our services, you consent to our collection and use of data as described in the Privacy Policy.
Termination
You may cancel your account at any time through your dashboard or by contacting support. We may terminate or suspend your account if:
- You violate these Terms
- Your payment fails
- Your account is inactive for an extended period
- Required by law or legal process
Intellectual Property
Karmoto and its original content, features, and functionality are owned by Karmoto and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
Limitation of Liability
To the maximum extent permitted by law, Karmoto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption arising from your use of or inability to use the service.
Indemnification
You agree to indemnify and hold harmless Karmoto and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these Terms.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the service. Your continued use of Karmoto after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
